What is Wasiat?
In Singapore, a Will is the only legal document accepted in the Singapore Courts. Translating Will to the Syariah Law, it means Wasiat.
A Wasiat is a document or instruction that a person made (known as a Testator/ Testatrix) during his/her lifetime with respect to his/her property or assets to be carried out for the purposes of charity or for any other purposes permissible by Islamic Law, upon his/her death.
The assets of Muslims who die without a Will or Wasiat will be distributed rigidly between their heirs in accordance to the Faraidh laws (the Islamic Law of Inheritance).
Apa itu Wasiat?
Wasiat ialah suatu pemberian yang disandarkan atau dikaitkan sesudah mati iaitu hanya akan terlaksana selepas pewasiat meninggal dunia.
Why do I need a Wasiat?
By having a Will/ Wasiat, the appointed trustworthy Executors would be able to distribute the assets to the named beneficiaries as wished by the Testator/ Testatrix. This would largely save time, emotional distress between family members and beneficiaries, and the cost of distributing the properties.

What is Hibah?
Hibah, also known as a Deed of Family Arrangement, is a declaration made by the Testator/ Testatrix to distribute his/ her assets to the beneficiaries as he/she wishes.
Hibah is derived from Arabic which is traditionally meant to be referred to a gift, such as money, to be given to someone without expecting anything in return.
Through Hibah, the transferring of the legal title and the possession of the gift to the recipient is done immediately. However, in Jalaluddin Services Will & Consultancy, we practice Hibah Ruqbah, or Conditional Hibah, where the Testator/ Testatrix will give his share of assets to the recipient of the Hibah during his lifetime but still owns the assets in its entirety until his death. Only then, would the share of the assets belong to the Beneficiaries.

Hadiah atau pemberian harta / milikan (sama ada harta alih atau tak alih) tanpa balasan oleh penghibah kepada penerima hibah secara rela hati semasa hayatnya di atas dasar kasih sayang dan kemanusiaan.
Why Do I Need Hibah?
Having a Hibah would be a useful document to supplement the Will/ Wasiat document in making full and clear explanation of the distribution of your assets.
Kenapa perlu membuat Hibah?
Kelebihan Hibah:
Harta yang telah dihibah akan terkeluar dari harta pusaka.
Harta yang telah dihibah tidak boleh dituntut oleh waris-waris yang lain.
Pewarisan atau pemindahan harta dapat dibuat dengan lebih mudah dan cepat.
Boleh diberikan kepada sesiapa pun; anak angkat, anak tiri, waris yang tidak menerima pusaka.
Jumlah yang diberikan tidak terhad.
Di JTS, pemberian semasa hidup melalui cara hibah boleh dibuat untuk kesejahteraan hidup orang yang disayangi tanpa had jumlahnya. Ia mungkin akan berguna untuk kepentingan mereka yang disayangi selepas ketiadaan anda.
What is Faraid?

Faraidh is the section in the Islamic Law that deals with the distribution of the estate of a deceased where the estate (or assets) are distribution to his/her heirs in accordance to Allah’s decree in the Holy Quran and the hadith.
